Dear President-elect Klaus Iohannis,<\/em><\/p>\n

During the last weeks you said you were preparing to be a mediating and integrating president, a binding element between state and society. In the short time left before you take over this role de facto, your position as leader of PNL (the National Liberal Party) provides you with the opportunity to start applying the values and principles for which Romanians gave you a vote of confidence.<\/p>\n

Two of these principles – transparency and responsibility at the level of central or local authorities – can be applied in the case of Certej as early as today, even by members of the party you are (still) leading.<\/p>\n

The cyanide mining project at Certej started to move forward, notwithstanding that<\/strong>:<\/p>\n

– It is similar to the Ro\u015fia Montan\u0103 project, and the permitting procedure was marked by countless controversies, abuses and suspicions of illegitimacies committed by state institutions since 1995.<\/p>\n

– The authorities acted in a manner which was non-transparent and clearly servile to the interests of Deva Gold SA, from the mining license transfer, the environmental impact assessment up to the issuance of the construction permit <\/a>for the site management works.<\/p>\n

– Romanian society in general is against cyanide mining projects in our country (see Diaspora’s Letter<\/a> or The Cluj Declaration<\/a> ).<\/p>\n

Petru C\u00eempian, mayor of Certeju de Sus and a party colleague of yours, refuses to abide by the law and hinders civil society’s access to extremely important documents related to the permitting and commencement of the first cyanide project in our country.<\/p>\n

Mayor C\u00eempian’s attitude \u2013 with its lack of institutional transparency and the whitewashing of abuses – should be subject to political sanctions, being just as corrosive for the rule of law as corruption deeds and conflicts of interest. Mr. President-elect, we therefore request you to act according to the values and principles undertaken by you during the election campaign for compliance with laws in the case of Certej.<\/p>\n

Sehr geehrter Herr gew\u00e4hlter Pr\u00e4sident Klaus Johannis,<\/p>\n

In den vergangenen Wochen haben Sie Ihre Bereitschaft erkl\u00e4rt, ein vermittelnder und integrierender Pr\u00e4sident, ein Bindeglied zwischen Staat und Gesellschaft sein zu werden. In der knappen noch verf\u00fcgbaren Zeit bis zur faktischen \u00dcbernahme dieser Funktion, erlaubt Ihnen Ihre Position als Pr\u00e4sident der PNL die M\u00f6glichkeit, jene Werte und Prinzipien in die Praxis umzusetzen, f\u00fcr die die Rum\u00e4nen Ihnen ihr Vertrauen ausgesprochen haben.<\/p>\n

Zwei dieser Prinzipien – Transparenz und Rechenschaftspflicht auf Ebene der zentralen und lokalen Beh\u00f6rden \u2013 k\u00f6nnen im Falle von Certej gleich heute noch zur Anwendung gebracht werden und das von Mitgliedern der Partei, welcher Sie (noch) vorstehen.<\/p>\n

In diesem Herbst ist das zyanidgest\u00fctzte Bergbauprojekt von Certej auf die Zielgerade eingebogen, obwohl<\/p>\n

es dem Projekt von Ro\u015fia Montan\u0103 gleicht und das Genehmigungsverfahren von zahlreichen Kontroversen, Verletzungen und mutma\u00dflichen Rechtsverst\u00f6\u00dfen seitens staatlicher Einrichtungen seit 1995 begleitet wurde;<\/p>\n

die Beh\u00f6rden sich intransparent verhielten und sich klar den Interessen der Deva Gold S. A. untergeordnet haben \u2013 von der \u00dcbertragung der Bergbaulizenz \u00fcber die Umweltvertr\u00e4glichkeitspr\u00fcfung bis zur Ausstellung der Baugenehmigung f\u00fcr den Standort;<\/p>\n

sich die rum\u00e4nische Gesellschaft geschlossen gegen Bergbauprojekte auf Basis von Zyanid in unserem Land ausspricht (siehe \u201eBrief der Diaspora\/ Scrisoarea Diasporei\u201c oder \u201eErkl\u00e4rung von Klausenburg\/ Declara\u021bia de la Cluj\u201c).<\/p>\n

Peter C\u00eempian \u2013 B\u00fcrgermeister von Certeju de Sus und Ihr Parteifreund \u2013 weigert sich, die gesetzlichen Vorgaben zu respektieren und der Zivilgesellschaft entsprechenden Zugriff auf wichtige Dokumente hinsichtlich der Genehmigung des ersten Zyanid-Projektes in unserem Land zu gew\u00e4hren.<\/p>\n

Die von Mangel an institutioneller Transparenz und der Vertuschungen gekennzeichnete Haltung B\u00fcrgermeister C\u00eempians muss politisch sanktioniert werden, da sie genauso sch\u00e4dlich f\u00fcr die Rechtsstaatlichkeit ist wie Korruptionsverbrechen und Interessenkonflikte.<\/p>\n

Herr gew\u00e4hlter Pr\u00e4sident, wir bitten Sie daher darum, da\u00df Sie sich im Einklang mit den im Wahlkampf vertretenen Werten und Prinzipien f\u00fcr die Durchsetzung der Gesetze im Falle von Certej einsetzen.<\/p>\n
