{"id":3864,"date":"2026-04-07T09:25:05","date_gmt":"2026-04-07T06:25:05","guid":{"rendered":"https:\/\/miningwatch.ro\/?p=3864"},"modified":"2026-04-21T15:11:59","modified_gmt":"2026-04-21T12:11:59","slug":"societatea-civila-sesizeaza-comisia-europeana-impotriva-legii-care-permite-exproprieri-pentru-proiecte-miniere-private","status":"publish","type":"post","link":"https:\/\/miningwatch.ro\/en\/societatea-civila-sesizeaza-comisia-europeana-impotriva-legii-care-permite-exproprieri-pentru-proiecte-miniere-private\/","title":{"rendered":"Abuse under a &#8220;false flag&#8221; EU: Civil society notifies the European Commission against the law that allows expropriations for private mining projects"},"content":{"rendered":"<main class=\"MTmSSTLvYZYvmwVpWAzICRLYkwmkKMeQPbg\"><\/p>\n<div data-scaffold-immersive-reader=\"\">\n<article>\n<div class=\"relative reader__grid\">\n<div data-scaffold-immersive-reader-content=\"\">\n<div>\n<div class=\"reader-article-content reader-article-content--content-blocks\" dir=\"ltr\">\n<div class=\"reader-content-blocks-container\">\n<p id=\"ember50\" class=\"ember-view reader-text-block__paragraph\">Sixty non-governmental organizations from Romania sent an official letter today to the President of the <a class=\"LzOggbcGDJzwAinOcasNavZGXtBXczaKvq \" tabindex=\"0\" href=\"https:\/\/www.linkedin.com\/company\/european-commission\/\" data-test-app-aware-link=\"\">European Commission<\/a>, <a id=\"ember51\" class=\"ember-view\" tabindex=\"0\" href=\"https:\/\/www.linkedin.com\/in\/ursula-von-der-leyen\/\">Ursula von der Leyen<\/a>, and the Deputy Secretary-General, Viviane d\u2019Udekem d\u2019Acoz, requesting the opening of an <strong>EU Pilot<\/strong> \u2013 a pre-infringement procedure through which the Commission verifies if a member state complies with European law \u2013 regarding draft law <strong>L143\/2026<\/strong>.<\/p>\n<p id=\"ember52\" class=\"ember-view reader-text-block__paragraph\">This law allows the <strong>expropriation of citizens in favor of private mining companies<\/strong> and eliminates essential environmental procedures. Until now, the state could only take land and houses for <strong>public utility<\/strong>: roads, schools, hospitals. With this law, mining companies receive <strong>pre-emption rights<\/strong> over lands within mining perimeters, and the state can trigger expropriation if the landowner does not agree to yield their property for the benefit of the mining project.<\/p>\n<p id=\"ember53\" class=\"ember-view reader-text-block__paragraph\">The organizations point out that the initiators of the bill are <strong>falsely and abusively using Regulation (EU) 2024\/1252<\/strong> to justify a package of measures that are not only not required by the EU but flagrantly contravene European law and the Constitution of Romania.<\/p>\n<p id=\"ember54\" class=\"ember-view reader-text-block__paragraph\"><em>\u201cThese measures are an attempt to force an expropriation regime in private interest, prohibited by both the Constitution and European law,\u201d<\/em> mentioned <a id=\"ember55\" class=\"ember-view\" tabindex=\"0\" href=\"https:\/\/www.linkedin.com\/in\/stephanie-roth-821822227\/\">Stephanie Roth<\/a>, representative of the Mining Watch Romania network, in the letter addressed to European officials.<\/p>\n<p id=\"ember56\" class=\"ember-view reader-text-block__paragraph\">The signatory organizations emphasize three essential facts:<\/p>\n<ul>\n<li><strong>EU regulations apply directly<\/strong> \u2014 they are not transposed into national legislation.<\/li>\n<li><strong>GEO 61\/2025<\/strong> has already created the institutional and procedural framework necessary for the application of Regulation (EU) 2024\/1252.<\/li>\n<li>L143\/2026 introduces measures that <strong>do not appear in European legislation<\/strong> and have no connection to the implementation of the regulation.<\/li>\n<\/ul>\n<p id=\"ember58\" class=\"ember-view reader-text-block__paragraph\">\u201cUnder these conditions, the bill raises serious questions regarding legislative intent and possible abuses,\u201d the official address submitted to Ursula von der Leyen states. Law L143\/2026 would pave the way for <strong>expropriations in favor of commercial projects<\/strong>, grant pre-emption rights to private companies, and reduce environmental protection. At the same time, it would <strong>limit judicial control<\/strong>, restrict public participation, and concentrate sensitive decisions at the central level.<\/p>\n<p id=\"ember59\" class=\"ember-view reader-text-block__paragraph\">Organizations remind that <strong>Art. 44(3) of the Romanian Constitution<\/strong> prohibits expropriation in the private interest, and <strong>Art. 17 of the EU Charter of Fundamental Rights<\/strong> and ECHR jurisprudence also prohibit such measures. The signatories warn that the adoption of L143\/2026 would represent <strong>\u201ca dangerous regression,\u201d<\/strong> with the potential to reignite major social tensions and fuel anti-European discourse.<\/p>\n<p id=\"ember60\" class=\"ember-view reader-text-block__paragraph\">The organizations are asking the Commission to open the EU Pilot procedure with Romania, analyze the compatibility of L143\/2026 with EU law, and <strong>publicly clarify that Regulation (EU) 2024\/1252 does not justify the proposed measures<\/strong>.
